This is a legally binding agreement between you (the “User”, “you”, or “your”) and Onion Knight Tor Browser Application (hereinafter referred to as the “App”, “we”, “us”, or “our”). By downloading, installing, accessing, or using the App, you agree to be bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, you must not use the App.

The App provides a combination of Tor-based anonymization and VPN (Virtual Private Network) services designed to enhance your online privacy, security, and anonymity. This is NOT a service for committing criminal acts. It is strictly an anonymity and privacy tool. You expressly agree not to use the App to violate any applicable laws or regulations in any jurisdiction from which you originate or into which you connect.

1. Eligibility and User Accounts

You must be at least 18 years of age (or the age of majority in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.

You are responsible for maintaining the confidentiality of your device and any session credentials. You are fully liable for all activities that occur under your device session on our servers. You agree to protect your device and the App from unauthorized access or use.

2. License and Use of the Service

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

You may not copy, modify, distribute, sell, sublicense, or reverse-engineer the App or any part of it.

3. Acceptable Use Policy & Prohibited Conduct

You agree not to use the App for any of the following:

• Sending spam, unsolicited emails, bulk emails, or any form of email marketing (even if routed through third-party servers).
• Port scanning, scanning for open proxies/relays, or any network probing activities.
• Launching pop-ups, advertisements, or any intrusive content from our service.
• Attacking, hacking, cracking, or otherwise interfering with any computer, network, or system (including but not limited to DDoS, phishing, distribution of viruses, malware, or ransomware).
• Any fraudulent, illegal, or harmful activities, including network sabotage, copyright infringement, or distribution of illegal content.
• Any activity that imposes an excessive or unreasonable load on our infrastructure or disrupts service for other users.

We reserve the right to suspend or permanently terminate your access immediately and without notice if we determine, in our sole discretion, that you have violated any of the above.

4. Privacy and No-Logs Policy

We take your privacy extremely seriously.

• We do not log any user activity, including websites visited, DNS lookups, emails sent/received, or any traffic content.
• We only log minimal connection attempts to our servers (for security, debugging, and abuse prevention).
• We do not collect any personally identifiable information inside or outside the App.
• We do not cooperate with any requests for user data unless compelled by a valid court order from a court of competent jurisdiction in the United States. The vast majority of such requests would not qualify. Our infrastructure is designed to automatically protect your anonymity to the maximum extent possible.

We do not engage in any form of censorship and will never block content based on political, religious, or ideological grounds.

5. Service Availability, Speeds, and Limitations

Actual service coverage, speeds, server locations, and quality may vary and are not guaranteed.

The App is provided on an “as is” and “as available” basis. We strive for 24/7 availability but may temporarily suspend service for maintenance, repairs, or updates.

We are not responsible for interruptions caused by force majeure, third-party failures, network congestion, equipment limitations, or any other factors beyond our reasonable control.

Network speed is an estimate only. Actual speeds depend on your device, connection type, compression, congestion, and other variables. We do not guarantee the accuracy or timeliness of any data transmitted through the App.

We may, in our sole discretion, impose usage limits, suspend service, or block specific usage patterns to protect the network or other users.

6. Fair Usage Policy

The App does not impose a strict bandwidth cap per user. However, all usage is subject to our Fair Usage Policy.

Excessive or abusive usage includes (but is not limited to):

• Creating automated or manual sessions that simulate bot activity.
• Consistently using substantially more bandwidth than an average user for an extended period.
• Any usage that interferes with or degrades service for other users.

We reserve the right to temporarily throttle, suspend, or permanently terminate accounts found in violation of fair usage.

7. Subscription and Payments

Onion Knight Tor Browser requires a paid subscription:

• $2.99 per month, or
• $7.99 per three months, or
• $29.99 per year (prices may vary by territory and are subject to change).

Payment is processed via Apple’s in-app purchase system (iTunes/App Store). Your subscription will automatically renew at the end of each billing period unless auto-renew is turned off in your Apple Account Settings at least 24 hours before the end of the current period. Apple will charge your account within 24 hours prior to the end of the current subscription term.

All payments are final and non-refundable except where required by applicable law. You are responsible for any taxes applicable to your use of the App.

8. Termination and Suspension

We may suspend or terminate your access to the App at any time, with or without notice, for violation of these Terms, abusive behavior, or to protect the integrity of the service.

Upon termination, your right to use the App ceases immediately. You remain responsible for any outstanding payments.

9. Intellectual Property

All content, trademarks, logos, and software associated with the App are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws. You acquire no ownership rights by using the App.

10. Disclaimers and Limitation of Liability

THE APP IS PROVIDED “AS IS” WITHOUT ANY WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Our total liability shall not exceed the amount you paid to us in the twelve months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold us harmless from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of your use of the App, violation of these Terms, or violation of any law or third-party rights.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via the App or by email (if provided). Your continued use of the App after the effective date constitutes acceptance of the revised Terms.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict of laws principles. Any disputes shall be resolved exclusively in the courts located in Boca Raton, Florida. You waive any objection to venue or jurisdiction in such courts.

14. Miscellaneous

If any provision of these Terms is held invalid, the remainder shall continue in full force. Our failure to enforce any right does not constitute a waiver. These Terms constitute the entire agreement between you and us regarding the App.
